A Pottawattamie County grand jury has decided not to indict an Omaha man on any charges in connection with a fatal shooting of a Council Bluffs man in December.

Grand jury members returned a “no bill” Monday afternoon after hearing from officials earlier in the day about the case. Pottawattamie County Attorney Matt Wilber said no charges will be filed against Stephen Hahn.

On Dec. 2, Hahn, then 67, fired one shot at Russ Atkins, killing him. Officers found Atkins dead in the 500 block of Grace Street in Council Bluffs.

Council Bluffs police said Atkins, 59, was in a domestic violence disturbance with a woman when Hahn tried to intervene.

Detectives found that a court-issued protection order was in place between Atkins and the woman, and Hahn knew both Atkins and the woman.

Hahn was legally permitted to possess the handgun he used and remained on the scene and was cooperative with detectives, police said.
