The owners of Omaha sports equipment firm Battle Sports Science are in a battle themselves over the business’s management.

Firm co-founder Jeff Evans said in a lawsuit filed this week that his partners schemed to fire him, block his access to company accounts and pursue new opportunities without him.

Defendents Christopher Circo and Tony Schrager deferred questions about the suit to their attorney, David Hefflinger, who did not respond to messages left Wednesday.

Battle Sports developed the Impact Indicator, a concussion-detecting football helmet chin strap, and other sports safety products. Evans and Circo founded Battle Sports in 2009.

Evans said Circo and Schrager through their own corporations transferred their interests in Battle Sports to a new firm, Active Brands, in June 2012, without Evans’ consent.

Evans, filing suit on behalf of Battle Sports, said Active Brands then “usurped” an opportunity rightfully belonging to Battle Sports, to form Prince Americas LLC and acquire the operating assets and exclusive rights to the Prince, Ektelon and Viking brands of racquetsports equipment in North and Latin America, from Prince Sports, which was operating under bankruptcy protection.

Evans said he has been locked out of the Battle Sports office and has been unable to prevent Circo and Schrager from spending money “recklessly” and breaching contracts.

Evans is asking for a jury trial and a judgment that he is entitled to control of Battle Sports, and that Battle Sports is the owner of equity interests in Prince Americas.

Circo told The World-Herald in June that Battle Sports Science had teamed up with Waitt Co. investment firm of Omaha to acquire the Prince assets, with Waitt a majority owner of new umbrella company Active Brands. Waitt CEO Dana Bradford did not return a call Wednesday inquiring about the suit. Waitt is not a party to the suit.

A Battle Sports spokesman said in June that the firm employed 12 in Omaha at its offices near 168th Street and West Center Road, along with 40 sales representatives.
