The Bellevue City Council is postponing a decision on filling an open council seat as it awaits an opinion from the Nebraska secretary of state.
The council voted 3-1 Monday to ask Secretary of State John Gale to issue an opinion on the process the mayor should use to choose an appointee.
The three council members who voted to seek the opinion disagree with Mayor Rita Sanders about who should fill the seat.
Those same three council members — Don Preister, Carol Blood and Steve Knutson — also disagree with an opinion received from City Attorney Pat Sullivan. They voted to ask Sullivan to seek clarification from Gale.
Councilman Paul Cook voted against the motion, saying the City Council should resolve the issue internally. He cited an article in The World-Herald in which Gale said he has never before been asked to provide an opinion on such a disagreement.
A fifth council member, Kathy Saniuk, was absent from Monday's meeting.
