A Blair, Neb., woman has been charged with involuntary manslaughter and child abuse due to negligence in connection with the death of a toddler at her day care facility.
According to an arrest affidavit filed in Washington County, Nancy Tierney, 59, left the children in her care unattended on Aug. 8, 2012, while she used the bathroom. During that time, a 16-month-old girl wandered into a pool in Tierney’s back yard and drowned.
According to the affidavit, Tierney told investigators she had checked the lock on the pool gate the previous evening “and believed it was secured.” Tierney’s daughter found the child floating in the pool.
The investigation indicated that it’s likely a 2-year-old opened the patio door while Tierney was in a bathroom on the second floor of the home, giving the toddler the opportunity to reach the pool.
The Nebraska Department of Health and Human Services revoked the day care license for Tierney, who had been approved to care for up to 10 children between the ages of 6 weeks and 13 years since 1983.
