LEXINGTON — A Kansas man pleaded not guilty in Dawson County District Court on Friday afternoon to charges in a fatal traffic accident.
Destry Swartz, 23, faces multiple charges in the death of Ruben Maravilla-Cortes, 68, of Lexington, including felony charges of motor vehicle homicide and flight to avoid arrest and a misdemeanor charge of driving while intoxicated.
If convicted, Swartz faces one to 20 years in prison on the motor vehicle homicide charge and up to five years for flight to avoid arrest.
District Judge James E. Doyle set Swartz’s trial date for Feb. 12, 2013.
Authorities said Swartz was being chased by a state trooper after running a stop sign when he ran a red light at an intersection and hit Maravilla-Cortes’ vehicle.
Maravilla-Cortes’ vehicle caught on fire and he died at the scene.
Swartz remained in the Dawson County Jail on $50,000 bail.
